How a Lawsuit Can Help

A lawsuit may provide compensation for medical expenses, therapy costs, medications, or other measures that can improve your quality of life. However, lawsuits also hold manufacturers responsible for their products, which can lead to positive change for everyone.

How Much Does It Cost?

Learning about your rights and how to protect them should never come with a cost. Speaking with our team does not cost anything, and neither does the evaluation.

3M Settles DOJ Lawsuit

In 2018, 3M settled a whistleblower lawsuit for $9.1 million to resolve allegations that the company knew about defects with the CAV2 earplugs but failed to disclose the defects to the military.

While the company paid the Department of Justice for purchasing the allegedly defective product, the company did not compensate the scores of men and women who depended on the earplugs to protect them from hearing damage.

Service members across the country are filing injury lawsuit against 3M alleging the company knew for years that the earplugs could imperceptibly loosen and allow concussive blast noise to bypass the earplugs and cause hearing damage but failed to warn the U.S. military of the defect.

What Happens When You File a Claim?

Once you submit your information for a free case evaluation, an attorney will determine if you have a claim. You and the attorney will determine how to move forward based on the specifics of your case, and your attorney will file documents with the court.

These documents make up your ‘complaint’ or lawsuit, and detail the specific facts about your case, like how and when you used the earplugs, your injuries, and how the hearing damage has impacted your life.

Your complaint will list the allegations being made against 3M including that it:

  • knew or should have known about the earplug defects, but
  • failed to warn the U.S. military about the risk of hearing damage, and
  • was negligent in the design and manufacturer of the earplugs, and
  • failed to take reasonable action to protect servicemembers’ hearing from harm.

How Much Will a Claim Cost?

Our firm is handling 3M hearing damage cases on a contingency fee basis only, which means that your attorney will take a percentage if you get a settlement or award. However, if you do not get a settlement or award, then you pay nothing.

What Compensation Could You Be Entitled to Receive?

Your complaint would seek justice and compensation from 3M Co. for injuries and damages you sustained due to hearing damage.

Some of the damages you may be entitled to receive include:

  • Past and future medical bills
  • Therapy costs and expenses
  • Medication costs
  • Lost wages
  • Loss of expected wages or earning capacity
  • Pain, suffering, and mental anguish
  • Loss of consortium
  • Loss of quality of life
